Driving Instructor Agreement



1. Scope and Agreement


1.1. This Code of Conduct ("Code") applies to all driving instructors ("Instructors") using the Learner Pass Pty Ltd ("LearnerPass") booking platform ("Platform").


1.2. The Code covers:


1.2.1. Platform usage

1.2.2. All subsequent lessons

1.2.3. All interactions with learner drivers ("Learners") sourced through the Platform


1.3. By using the Platform, Instructors explicitly agree to comply with this Code of Conduct.



2. Consequences of Non-Compliance


2.1. Failure to adhere to this Code may result in an Instructor losing Platform access privileges, at LearnerPass's sole discretion.


2.2. LearnerPass reserves the right to:


2.2.1. Suspend an Instructor's account temporarily

2.2.2. Terminate an Instructor's account permanently

2.2.3. Take any other action deemed necessary to enforce compliance



3. Purpose


3.1. This Code outlines LearnerPass's standards for Instructors using the Platform.


3.2. The Code supports LearnerPass's mission of:


3.2.1. Connecting Learners with qualified Instructors

3.2.2. Ensuring professional conduct by Instructors

3.2.3. Maintaining a focus on safety in driving instruction



4. Legal Compliance


4.1. Instructors must comply with all applicable federal, state, and local laws where they operate, including but not limited to:


4.2. Licensing and Accreditation:


4.2.1. Maintaining a valid driver's licence

4.2.2. Holding a current instructor's licence

4.2.3. Possessing an up-to-date working with children check

4.2.4. Having a current national police check

4.2.5. Keeping all other required accreditations current


4.3. Traffic Laws:


4.3.1. Following all road rules and regulations

4.3.2. Adhering to speed limits

4.3.3. Complying with parking restrictions

4.3.4. Obeying all traffic signs and signals


4.4. Vehicle Requirements:


4.4.1. Ensuring the vehicle is fully registered

4.4.2. Maintaining the vehicle in a roadworthy condition

4.4.3. Keeping the vehicle clean and presentable

4.4.4. Equipping the vehicle with all necessary safety features



5. Professional Conduct


Instructors shall:


5.1. Demeanor:


5.1.1. Maintain a courteous and professional demeanor at all times

5.1.2. Interact respectfully with Learners, prospective clients, LearnerPass staff, and all other individuals


5.2. Instruction:


5.2.1. Provide the full duration of instruction as booked by the Learner

5.2.2. Give Learners undivided attention during the entire lesson period

5.2.3. Focus solely on providing quality instruction


5.3. Communication:


5.3.1. Promptly notify affected Learners via the LearnerPass platform if unable to complete a scheduled lesson

5.3.2. Provide clear reasons for any cancellations or changes

5.3.3. Offer options for rescheduling or connecting with an alternative Instructor


5.4. Payment:


5.4.1. Only claim payment through the Platform after the lesson has been fully completed

5.4.2. Accurately report the duration and nature of services provided


5.5. Quality of Instruction:


5.5.1. Deliver competent, high-quality driving instruction to the best of their ability

5.5.2. Consistently set a positive example through their own driving practices

5.5.3. Regularly update knowledge of road rules, safe driving practices, and instructional techniques


5.6. Punctuality and Preparation:


5.6.1. Arrive punctually for all scheduled lessons

5.6.2. Allow sufficient time for proper lesson preparation

5.6.3. Ensure all necessary materials and equipment are ready before the lesson begins


5.7. Record Keeping:


5.7.1. Keep accurate and up-to-date records of all lessons conducted

5.7.2. Maintain detailed progress notes for each Learner

5.7.3. Securely store all Learner-related information in compliance with privacy laws



6. Prohibited Conduct


Instructors must not:


6.1. Behavior:


6.1.1. Engage in any form of offensive behavior

6.1.2. Display discriminatory attitudes or actions

6.1.3. Use abusive language or conduct

6.1.4. Act in an unprofessional manner towards Learners, LearnerPass staff, or any other individuals


6.2. Distractions:


6.2.1. Use mobile phones while providing driving instruction

6.2.2. Smoke in the vehicle at any time

6.2.3. Eat or drink while providing instruction

6.2.4. Engage in any activity that may distract from the lesson


6.3. Unauthorised Persons:


6.3.1. Allow unauthorised third parties to be present in the vehicle during lessons

6.3.2. Exception: When explicit consent has been obtained in advance from the Learner (or their parent/guardian for minors)


6.4. Payments:


6.4.1. Accept any form of payment or benefit from a Learner outside of the LearnerPass Platform

6.4.2. Offer discounts or incentives for direct bookings


6.5. Misrepresentation:


6.5.1. Misrepresent themselves as employees, representatives, or agents of LearnerPass

6.5.2. Provide false or misleading information about qualifications, experience, or services offered


6.6. Privacy and Data Protection:


6.6.1. Disclose any personal information about Learners to third parties without express written consent, except to a Government agency or authorised examiner for the purposes of booking a driving test 

6.6.2. Use a Learner's personal information for any purpose other than providing driving instruction or booking tests


6.7. Recording:


6.7.1. Take photographs, videos, or recordings of Learners without their explicit consent (or that of their parent/guardian for minors)

6.7.2. Exception: In-car dash-cam front and cabin recordings as required by law


6.8. Competition:


6.8.1. Attempt to poach Learners from LearnerPass for private instruction

6.8.2. Recommend competing services to Learners


6.9. Harassment:


6.9.1. Engage in any behavior that could be perceived as harassment

6.9.2. Make unwanted physical contact

6.9.3. Use inappropriate comments or jokes

6.9.4. Conduct themselves in a way that could reasonably offend, humiliate, or intimidate others


6.10. Vehicle Condition:


6.10.1. Conduct lessons in a vehicle that is not properly maintained

6.10.2. Use a vehicle that is not registered for instructional purposes

6.10.3. Operate a vehicle that is not adequately insured for driving instruction



7. Non-Discrimination


7.1. Instructors shall not discriminate against any person based on protected attributes including but not limited to:


7.1.1. Age

7.1.2. Disability status

7.1.3. Gender identity

7.1.4. Marital status

7.1.5. Race

7.1.6. Religion

7.1.7. Sex

7.1.8. Sexual orientation


7.2. Instructors must provide equal service and opportunities to all Learners, regardless of their background or characteristics.



8. Harassment Prevention


8.1. Instructors must not engage in any form of harassment, including but not limited to:


8.1.1. Sexual harassment

8.1.2. Verbal harassment

8.1.3. Physical harassment

8.1.4. Psychological harassment


8.2. Prohibited conduct includes:


8.2.1. Unwelcome physical contact

8.2.2. Inappropriate comments or jokes

8.2.3. Any conduct that could reasonably offend, humiliate, or intimidate others


8.3. Instructors must maintain professional boundaries at all times.



9. Safety Responsibilities


Instructors shall:


9.1. Legal Compliance:


9.1.1. Comply with all applicable work health and safety laws

9.1.2. Adhere to road safety regulations and best practices


9.2. Risk Management:


9.2.1. Take reasonable precautions to ensure their own safety

9.2.2. Ensure the safety of Learners during instruction

9.2.3. Properly manage risks associated with in-vehicle instruction


9.3. Vehicle Safety:


9.3.1. Regularly inspect and maintain the instruction vehicle

9.3.2. Ensure all safety features are functional

9.3.3. Address any safety concerns immediately


9.4. Emergency Preparedness:


9.4.1. Have a clear emergency action plan

9.4.2. Know how to respond to various road emergencies

9.4.3. Keep emergency contact information readily available



By agreeing to this Code of Conduct, Instructors commit to upholding these standards in all their interactions and activities related to the LearnerPass Platform.
